<description>&#60;p&#62;I assume this is a beat up from Owen's Guns that the preposed changes to the legislation will result in the following &#34;If we do nothing, Queensland will make law in Mid October 2011 banning centre fire rifles which have a built in magazine capacity of over 10 shots, pump actions, lever actions anything that can take 11 shots, will have to be handed in for NO compensation.That means Model 1866 (Henry) Winchester, Model 1873 Winchesters, Model 1892 Winchester’s 1873, likewise Browning, Marlin, Remington, Rossi, Puma, Colt Lighting, Chiappa, Uberti, Henry, Timberwolf, and  Remington Pumps, one in the chamber puts the rifles built in magazine capacity at 11 and if you have done the right thing and registered that rifle you will have to hand it in for no compensation. &#34; &#60;/p&#62;

<description>&#60;p&#62;Well here goes, another radical idea, I would like to submit the following draft proposal to the members of this Forum to consider, comment on, and add to if necessary. I further propose that 2 weeks from the date posted that a final draft be drawn up and sent by this forum's members to any/all elected State Government Representatives seeking their support. The proposal should also be sent to their respective Associations/Clubs requesting that, as our 'elected representatives in the shooting field', they show support for this proposal. I realize that this will cause Some Slack A@$$*d Associations to stick their heads further into the sandpit and their backsides higher into the air so they can be fornicated over even more. (Admin; feel free to edit that last bit if you feel it is offensive)&#60;/p&#62;
&#60;p&#62;The Proposal&#60;/p&#62;
&#60;p&#62;Due to the increase in crime rates, particularly violent crime against householders, (statistics available from the ABS, AIC etc) it is proposed that &#34;Defense be allowed as a genuine reason for a Firearms Licence&#34; trial be conducted.&#60;br /&#62;
The Trial: to be conducted over a period of not less then 2 years. This period is to allow representative statistical figures to be gathered and assessed.&#60;br /&#62;
The Licences: For the Trial period, a limited number of Licences to be issued on a 1 year (12 month)basis, and the numbers issued to any area or region will reflect the population density/crime rate (higher the crime rate/ area or region, the larger the number of Licences issued). The Licence fee will be the same as the rates for a yearly Licence available at the time.&#60;br /&#62;
The Licencee: For the Trial period, persons applying for a Licence must;&#60;br /&#62;
For a longarm, be member of an approved Gun Club,&#60;br /&#62;
Have Certificate of Obtainment from a Security Guard (Armed) Course,&#60;br /&#62;
Attend a minimum 1 qualification shoot/year.&#60;br /&#62;
For a handgun, be member of an approved Gun Club,&#60;br /&#62;
Have had handgun Licence for minimum period (3 or 5 years),&#60;br /&#62;
Have Certificate of Obtainment from a Security Guard (Armed) Course,&#60;br /&#62;
Attend a minimum 2 qualification shoots/year.&#60;br /&#62;
Firearms: For the Trial period, approved by relative authority for defence use (Cat. Class and Cal.). Only Firearms registered to Defence Licence to be used for that purpose.&#60;br /&#62;
Assessment/Feedback: A open forum is to be conducted involving the following parties, Government, Law Enforcement, LAFOs and the Public, no later than 6 months from the end of the Trial Period. This time period (6 months) is to allow the data to be collected, collated and disseminated to the parties involved (Government, Law Enforcement, LAFOs and the Public).&#60;br /&#62;
This Proposal should be viewed more as a means to deter the criminal activities outlined at the beginning of the Proposal than as grab by redneck, Dirty Harry wannabes to go armed in public, and as such should involve an aggressive public education campaign conducted at the same time as the Trial.&#60;/p&#62;
&#60;p&#62;Well there it is folks, lets do whats Forums are supposed to do, and see if we can't come up with something that may change history here in Qld.

<description>&#60;p&#62;UPDATE !!!  A win for shooters and a win for common sense &#60;/p&#62;
&#60;p&#62;The Queensland Government planned to introduce a new Weapons Act into Parliament in early August 2010.  LAFO bought this problem to the attention of Queensland's Law Abiding Firearm Owner Owner's in July 2010.  In response to public interest, the Queensland Government released a draft consultation Bill and Regulation for feedback.  We commend the ALP Government, especially Police Minister Roberts, for this decision. LAFO officials met with the Queensland Police Minister on Wednesday 15 December 2010 and more recently with the Queensland Opposition Police Minister.  Both meetings were fair and productive. A LAFO Issues Bulletin was expected to be published in February advising of the latest developments but due to staff illness, this will now be released in late March.  &#60;/p&#62;
&#60;p&#62;HOWEVER a WIN-WIN outcome has been achieved. Please go to &#60;a href=&#34;http://www.lafo.com.au&#34; rel=&#34;nofollow&#34;&#62;http://www.lafo.com.au&#60;/a&#62; and read the Ministerial statement made on Thursday 10 March by Police Minister Roberts.  Minister Roberts has confirmed that only noncontentious common sense amendments will be made to the current Weapons Act 1990.&#60;/p&#62;
&#60;p&#62;LAFO understands that the poorly written, poorly conceived, unjust and unnecessary draft exposure Bill that was provided for public comment has been dumped, as it should be.  LAFO officials will clarify the situation with the Queensland Government as soon as possible.  &#60;/p&#62;

&#60;p&#62;Many things I am happy with... tougher penalties for committing crimes with weapons. &#60;/p&#62;
&#60;p&#62;One thing (and this is well known :) ) is that I do not want restrictions on magazine capacity.&#60;/p&#62;
&#60;p&#62;Note:&#60;/p&#62;
&#60;p&#62;68CA Prohibition on possession of particular&#60;br /&#62;
magazines—category B weapons&#60;/p&#62;
&#60;p&#62;Maximum of 10 shot mags for lever or pump action rifles, and 15 shot mags for other centrefires. No restriction on Cat A.&#60;/p&#62;
&#60;p&#62;There is no justification for this, real or even (arguably) percieved. There is no compensation in there for those that own magazines of higher capacity - which can cost hundreds each. There is no accomodation for ownership of the magazines under my collectors license, unless I own a Cat D or R (no mention of C) deactivated collectors piece for which they suit.&#60;/p&#62;
&#60;p&#62;So you can own a 30 shot pump action detachable mag 22magnum or 22LR (Cat A) but you cant have more than 10 in a 7615 .223. Sure, the 7615 arguably has more power, but I am pretty sure 30 .22 Mag rounds inside 100 metres would be just as deadly as 10 .223. &#60;/p&#62;
&#60;p&#62;Whilst most LAFOs would be prepared to roll with this one as they probably only use 10 shot mags anyway, its not the point. Its this perception that restrictions on law abiding owners somehow stops crimes. Its crap. We know and always have said crims dont care about the law. This is another restriction for the sakes of it that will do nothing for public safety or crime prevention. &#60;/p&#62;
&#60;p&#62;Allowing this to go through just sets (probably a better term would be 'confirms') a precedent for permitting every bleeding heart to take something away or restrict it with no real justification. And of course those groups will say &#34;Well you dont NEED 20 shot mags&#34; and as the time old counter to that is &#34;when has ownership been dependant on need?&#34;.. and I think thats very important.&#60;/p&#62;
&#60;p&#62;I guess the other thing its not like they offered up anything FOR us. Like WA allowing Cat C shotguns to sporting shooters for some events (practical and single action), or included IPSC in allowable competitions for &#38;gt;.38 calibre pistol, and so on.... or even something cooler like 1 (only)Cat D firearm to service rifle shooters whom meet fairly extensive pariticipation requirements and the usual Cat D safety protocols.... yeah I know a man can dream :).&#60;/p&#62;
&#60;p&#62;It just seems another erosion of our freedoms - I cant say rights as we need it on a bit of paper to have those, aparently. I'd argue that by default everyone has the right to anything they want, unless its legislated against (and thus taken away). Just because its not on a peice of paper ratified by a legislative body doesnt make it true.&#60;/p&#62;
&#60;p&#62;Anyway going to read more closely the other sections. These are my initial thoughts/reactions

<description>&#60;p&#62;Relatively new AB licence holder in QLD, I am struggling to understand the Weapons Act and looking for advice. Like lots of folk I have a thing for the SMLE. I have two  No 1's and have been granted permission to get a third. The new addition is a 1902 carbine (5 round mag) which I see as quite distinct compared to a No1, Mk III. I am keen to get to my hands on Lee/Metford/Enfield pre WWI rifles. Trouble is I doubt I will be given the OK to own more 303 cal rifles. I looked at the collector’s license but as I understand it this bit of paper does not allow you to shoot the weapons in your collection (must be temporarily inactivate). Is that correct? So if you have an addition for historically relevant rifles of the same cal, tough as you be unlikely to be given permission to own more than? three on a std AB license. Have I got this right?

I'm a solicitor.  I do lots of criminal defence, family law and other litigation.  Also i do some construction law.&#60;/p&#62;
&#60;p&#62;And before you label me as one of those defending crims for the dough.  I don't.  I plead the guilty ones guilty and take the innocent ones to trial.&#60;/p&#62;
&#60;p&#62;Hence i haven't lost at trial yet.  Plus you guys would never heard of incompetent Police prosecuting the POOR or the INNOCENT because it makes them feel better and helps BOOST their careers.&#60;/p&#62;
&#60;p&#62;Anyways, i love firearms.  You can find me at the Ripley Range at the Cowboy Shoots or at the Indoor Range at Ipswich.  Convenient having a pistol range around the corner from my office!!!&#60;/p&#62;
&#60;p&#62;I'm a swing voter because i'm not sure which of the leaders lies the most.  Julia the liar or Abbot the &#34;honest liar&#34;?  God i love to cross-examine both of them!!  So you took over the job from your predecessor of which you backed all his policies, but coz they weren't popular, you knifed him in the back? &#60;/p&#62;
&#60;p&#62;Tony - so in 2010, you admitted you lied to the Public!  So are you lying now?  Were you lying then?  I see he is an honest liar!?!?!  &#60;/p&#62;
&#60;p&#62;Can't vote green coz they want to ban all pistols?  Apparently, hundreds of guns were stolen by CRIMINALS last year?  REALLY, Criminals ACTUALLY BREAK THE LAW?  &#60;/p&#62;
&#60;p&#62;So if there are millions of traffic accidents around Australia we should ban ALL Motor Vehicles because BAD DRIVERS kill people?  The clarity of his arguement is in dispute.&#60;/p&#62;

&#60;p&#62;I put my PTA in for a brand new Remington 700 on the 14th of Jan. I have 8 weapons on my firearms license weapons list, 2 of which should have had notice of disposals a month before that because I handed them in as trade in deposits on said Remington.&#60;/p&#62;
&#60;p&#62;The Remington is in at Rebel and I'd very much like to pick it up and pay the balance. No PTA. Mate of mine submitted at least 4 PTAs 2 WEEKS after mine, and he got all 4 back today. &#60;/p&#62;
&#60;p&#62;I thought I was doing the right thing by not hassling WLB .... but now I am really annoyed.

I would love to see what other people think about lots of searching and phonecalls I made regarding the 338 lap mag on ranges on QLD and the response I recieved from the club that mocst people would try first in their search for a range to shoot on. At the end of the day I know its our mates in blue that have forced this in but the reasons I was given left me with no clue.&#60;/p&#62;
&#60;p&#62;First I was told that their range (all of them) wasnt available because the 338 lap could overshoot it. Correct me if wrong please, but if something like a 300 win mag or 7mm rem mag was lifted from the bench would not they overshoot too?&#60;br /&#62;
Second I was also told that it was outside the range for their allowed muzzle velocity???? What about a swift???? They have a pretty hefty muzzle velocity.&#60;br /&#62;
Wouldnt it come down to the safe responsible manner in which the shooter conducts his or herself that maintains a safe environment.&#60;br /&#62;
Heaven forbid if there was ever an accidental discharge back towards the road in the oposite direction from the range, but is it not safe practice, proceedures and responsible shooters that stop this from occuring! Would it not be the case that the same things would stop an &#34;overshoot&#34; at somewhere like Belmont, whether its a 338 lap mag or 7mm rem mag.&#60;/p&#62;
&#60;p&#62;Having said all that, can anyone help or maybe point in the right direction? I've got a 338 Lap Mag that I want to do some load testing for. Up to this point I had people telling me that Ripley or Milmerran were the options but after many calls to many people it appears that there are no ranges in QLD that you can shoot it. I can and will drive out to the closest property I shoot on but if anyone knows of a range or somewhere a safe, responsible lafo could do some load testing, thats less than 4 hrs drive from Brissy it would be a godsend because I've hit the proverbial brick wall.&#60;br /&#62;

&#60;p&#62;If 338 Lapua can be the subject of what amounts to an administrative or policy prohibition, this allows WLB to ban calibers wherever they can make a reasonable case.  I don't see why even 7.62x51mm and .300 Win, amongst many others, couldn't ultimately be depicted as dangerous high-velocity cartridges.&#60;/p&#62;
&#60;p&#62;Permit to acquire regime&#60;/p&#62;
&#60;p&#62;The PTA regime sets out (at s 42(3), Weapons Act 1990 (Qld) (the Act)), for the consideration of authorised officers deciding applications, a need to consider whether the applicant's need can be met:&#60;br /&#62;
1. Not involving the use of a weapon, or&#60;br /&#62;
2. By using a weapon of another category or type.&#60;/p&#62;
&#60;p&#62;It seems to the me that the only grounds on which your genuine need of a weapon can be rejected are:&#60;br /&#62;
1. That your need can be met without the use of a weapon (eg. you can fulfil the need with a feather duster), or&#60;br /&#62;
2. That your need can be met by using a weapon of another category (eg. you can fulfil the need with a category A weapon),&#60;br /&#62;
3. That your need can be met by using a weapon of another type (eg. you can fulfil the need with a sword).&#60;/p&#62;
&#60;p&#62;Grounds for rejection 1 and 2 are clear enough.  Ground 3 is a little murkier.  'Type' is not a defined term and therefore takes its ordinary meaning.  In Australia, the first stop is the Macquarie Dictionary.  I don't have a copy of that dictionary at home, but I imagine the meaning is very general.&#60;/p&#62;
&#60;p&#62;Considering the language of the section, a court or tribunal could give one of two meanings to 'weapon of another [...] type':&#60;br /&#62;
1. Any other weapon, including weapons of same category.&#60;br /&#62;
2. A weapon operating on entirely different principles to the weapon that is the subject of the PTA application.&#60;/p&#62;
&#60;p&#62;If a court or tribunal gave the phrase meaning 1, then WLB would be free to reject an application for a PTA for a weapon of a particular caliber on ground 3 in favour of a weapon of another caliber in the same category.  For example, if you applied for a PTA for a 7.62x51mm category B and your genuine need could be met with a smaller caliber category B, then WLB would be free to reject your application on ground 3.&#60;/p&#62;
&#60;p&#62;If a court of tribunal gave the phrase meaning 2, then WLB would only be free to reject an application for a PTA for a weapon of a particular caliber on ground 3 in favour of a  weapon that operates on entirely different principles.  For example, if you applied for a PTA for a 7.62x51mm category B and your genuine need could be met with a smaller caliber category B, then WLB would not be free to reject your application on ground 3.  If your genuine need could be met with a sword, then WLB would be free to reject your application on ground 3.&#60;/p&#62;
&#60;p&#62;The Explanatory Notes to the Weapons Amendment Bill 1996 (Qld) are entirely unhelpful.  The Notes use the word 'type' in the same way we now use 'category'.&#60;/p&#62;
&#60;p&#62;Previous decisions&#60;/p&#62;
&#60;p&#62;I've been unable to find any previous decisions that consider the meaning of 'weapon of another [...] type' in s 42(3) of the Act.&#60;/p&#62;
&#60;p&#62;Approaches&#60;/p&#62;
&#60;p&#62;It occurs to me there are two approaches for dealing with an administrative prohibition of 338 Lapua by WLB.&#60;/p&#62;
&#60;p&#62;1. Apply to QCAT for review of a rejection of a PTA application for 338 Lapua (cheapest).  If that fails, appeal to QCATA (cheap).  If that fails, consider an appeal to the Queensland Court of Appeal (not cheap).&#60;br /&#62;
2. Have a representative shooting group (such as LAFO) enter into correspondence with WLB about it.&#60;/p&#62;
&#60;p&#62;I'm happy to elaborate on any point or discuss anything I haven't considered.

<description>&#60;p&#62;By the way, has any Pollie, Law Enforcement Officer or antigun congratulated the LAFO's at the Bellmount Range for steadfastly abiding to letter of the law by not defending themselves or their/others property. No?? Wouldn't mind betting they get charged with breaching the Weapons Act though, something to do with incorrect storage or something, and any LAFO knows what a breach of the Weapons Act charge on your Police record means if you wish to partake in your sport of shooting, regardless of any court hearing outcome.&#60;br /&#62;
Am I the only one or does anyone else see the problem with the laws that allow the criminal element to openly target, and endanger the lives of LAFOs in the process, shooting ranges. What's next, Police Stations, Defence Establishments, I know of at lest one whose armory is monitored by civilian security thousands of kilometers away.

&#60;p&#62;Go to the LAFO web site, login and you will be in your Profile page. Scroll to the bottom of the page and there you will find the Avatar option. Use whatever size avatar you like but remember it will be resized to 80x80 pixels and it is your bandwidth for the size you upload. I would recommend at least 300 pixels to retain some detail before uploading your avatar. Click on the &#34;Update Profile&#34; button at the bottom of the page (sorry I missed this step in the email).&#60;/p&#62;
&#60;p&#62;Go to the Forum login to your account, at the top of the page, following the “Welcome”, click on “View your Profile”. Now click in the Avatar tag and it is the same as for the Web site.&#60;/p&#62;
